Lerner and Rowe Injury Attorneys would like to remind our clients and friends in Las Vegas that there will be new Nevada child seat laws enacted starting January 1, 2022. The new laws are detailed in Nevada Assembly Bill 118 (AB118). To help make sure that you are in compliance with the new laws, our Las Vegas personal injury attorneys will explain the new child seat requirements below.
What Are the New Nevada Child Seat Laws?
In 2022, Nevada’s child seat laws will change in two significant ways. First, children under two years old must be placed in a rear-facing child restraint system in the back seat of the motor vehicle. This requirement is based on updated recommendations made by the United States Department of Transportation in accordance with the Federal Motor Vehicle Safety Standards.
Secondly, children that are under 6 years old or under 57 inches tall (4’9”) must use a child restraint system. The child restraint system can be a booster seat or a harnessed car seat. This updated requirement is based on a child’s age and height, whereas the previous requirement was based on age and weight. This law was also updated based on guidance from the United States Department of Transportation.

What Will Nevada’s Child Seat Laws Accomplish?
The new Nevada child seat laws are meant to provide additional protection for children under six years of age in the event of a car accident. By expanding the requirements of child restraint systems, more children will be protected by safety seats. Additionally, it was found that height was a more useful metric than weight when it comes to car seat use, as adult seat belts do not provide adequate protection for children under 4’9”, regardless of their weight.
