The Rules
Entries must be received by midnight PST on Wednesday, October 10, 2018. Must be at least 18 years of age to enter. Lerner & Rowe is not responsible for entries that are late, incorrect, misdirected or misrouted. Winner MUST download the Ticketmaster app and sign up for an account to receive digital tickets.
ELIGIBILITY.
This Lerner & Rowe Arizona Coyotes Ticket GIVEAWAY is open to individual persons (each, an “Entrant”) who are 18 years of age or older and are legal residents of the 50 United States including the District of Columbia. Officers, directors, employees, contractors, representatives, and agents of Lerner & Rowe Injury Attorneys, its parent companies, subsidiaries and affiliates, are not eligible. All federal, state and local laws and regulations apply. Void where prohibited or restricted. By entering this GIVEAWAY, Entrants agree to be bound by these Official Rules and the decisions of the Lerner & Rowe and/or its agents. By entering this Sweepstakes, Entrant agrees that, unless Entrant otherwise opts out by emailing Lerner and Rowe® at [email protected], the Entrants social media name will be used for promotion on Lerner and Rowe® social media pages.
DRAWING AND ODDS OF WINNING.
Lerner & Rowe will determine SEVEN winners by a random drawing of all entries properly and timely received, which drawing is scheduled to be held the morning of Thursday, October 11, 2018. The GIVEAWAY shall be conducted by Lerner & Rowe whose decisions are final and binding with respect to all aspects of the GIVEAWAY . The odds of winning the Prize will be determined by the number of eligible entries received prior to the GIVEAWAY deadline. Any Entrant who is selected in the GIVEAWAY shall be deemed a potential Winner, and such Entrant and his or her entry shall be subject to verification and the requirements of these Official Rules.
No Entrant shall be a Winner unless and until his or her entry and any other submissions required by these Official Rules (including, without limitation, affidavits of eligibility publicity releases, liability waivers and/or IRS Forms W-9s) are validated. PARTICIPANTS MAY ENTER MULTIPLE TIMES DAILY BY TAGGING A NEW FRIEND EACH TIME.
PRIZE WINNER NOTIFICATION.
Lerner & Rowe will notify Winner via the social media channel they entered on. Lerner & Rowe may require Winner to execute an affidavit of eligibility, publicity release (except where prohibited), liability waiver, IRS Form W-9, affidavit of non-transferability and/or exculpatory agreements, prior to the delivery of the Prize. If Winner does not respond to the Prize notification within 72 hours or is found to be ineligible, Lerner & Rowe will consider the Winner to have forfeited the Prize, and Lerner & Rowe will select an alternate winner from the pool of eligible entries. If the alternate winner fails to respond to the Prize notification within 72 hours or is found to be ineligible, Lerner & Rowe will consider the alternate Winner to have forfeited the Prize, and Lerner & Rowe will select a second alternate winner from the pool of eligible entries.
If the second alternate winner fails to respond to the Prize notification within 72 hours or is found to be ineligible, Lerner & Rowe will consider the second alternate Winner to have forfeited. All unclaimed Prizes will not be awarded. Lerner & Rowe reserves the right to disqualify any Entrant for any reason, including, without limitation, if Entrant has not complied with these Official Rules or has interfered, in Lerner & Rowe’s sole opinion, with the proper conduct of these Sweepstakes. Payment of any/all taxes is the sole responsibility of the Winner. Winner may be required to sign and return by mail within ten (10) days of receipt the Affidavit of Eligibility and Release and substitute W-9 form (including social security number). If the Winner fails to return these forms within the time required the Prize will be forfeited. Prior to receiving a Prize, Winner will be required to comply with rules and regulations, specifically including but not limited to execution by Winner of a liability waiver and release prior to receiving the Prize.
LIABILITY.
Prize acceptance constitutes permission (except where prohibited) to use Winner’s name and likeness for publicity purposes without compensation therefor. Lerner & Rowe and its promotional and advertising agencies, and all respective officers, directors, employees, representatives and agents of each, shall have no liability and shall be held harmless by Winner for any damage, loss of liability to persons or property, due in whole or in part, directly or indirectly by reason of the acceptance, possession, use or misuse of Prize or participation in this GIVEAWAY. Lerner & Rowe reserves the right, in its sole discretion, to cancel, terminate, modify, or suspend part or all of this GIVEAWAY should unauthorized human intervention or other cause beyond the control of Lerner & Rowe corrupt or impair the administration, security, fairness or proper play of the GIVEAWAY.
Lerner & Rowe and its promotion and advertising agencies, and all respective officers, directors, employees, representatives and agents of each, are not responsible for fraud or by any technical or human error which may occur in the processing of submissions which may limit an Entrant’s ability to participate in the GIVEAWAY. Lerner & Rowe reserves the right at its sole discretion to disqualify any individual Lerner & Rowe reasonably believes to have tampered with the entry process or with the operation of the GIVEAWAY, or who is found to be acting in violation of these Official Rules. This GIVEAWAY is intended and limited for play in the United States and shall only be construed and evaluated according to United States law.
DISPUTE RESOLUTION; LIMITATION OF LIABILITY.
Each Entrant agrees to release, defend, indemnify and hold harmless Lerner & Rowe Injury Attorneys, its parent companies and/or affiliates, and those working on their behalf, and each of their respective officers, directors, representatives, employees, agents, successors and assigns, from any damage, injury, death, loss or other liability, either at law or equity, whether known or unknown, asserted or non-asserted, that may arise from or in any way related to Entrant’s participation in the GIVEAWAY or the awarding, acceptance, use or misuse of Prize. Any and all disputes, claims, and causes of action arising out of or in connection with this GIVEAWAY shall be resolved individually, without resort to any form of class action.
This GIVEAWAY shall be governed by and construed in accordance with the laws of the state of Arizona, regardless of principles of conflicts of laws that may require the application of the laws of another jurisdiction. Any action or litigation concerning this GIVEAWAY shall be in the state court in and for Phoenix, Arizona. Each Entrant expressly consents to the jurisdiction of and venue in such courts and waives all defenses of lack of jurisdiction and inconvenient forum with respect to such courts. Each Entrant agrees to service of process by mail or other method acceptable under the laws of the State of Arizona. ANY CLAIMS, JUDGMENTS AND/OR AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS ASSOCIATED WITH ENTERING THIS PROMOTION. ENTRANT HEREBY WAIVES ANY RIGHTS OR CLAIMS TO ATTORNEYS’ FEES, INDIRECT, SPECIAL, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ENTRANT, WHETHER FORESEEABLE OR NOT AND WHETHER BASED ON NEGLIGENCE OR OTHERWISE.
GENERAL CONDITIONS.
This GIVEAWAY is subject to all applicable federal, state and local laws and regulations. By entering this GIVEAWAY, each Entrant agrees to be bound by these Official Rules and the decisions of Lerner & Rowe and to accept delivery of a Prize based upon availability. In addition, each Entrant represents and warrants that all information contained in his or her entry is true and accurate. Lerner & Rowe is not responsible for any printing or typographical errors in these Official Rules.
Lerner & Rowe reserves the right to cancel this GIVEAWAY at any time and substitute another promotion in its place. Lerner & Rowe is not responsible for injury or damage to Entrants’ or to any other person’s computer related to or resulting from participating in this GIVEAWAY. In the event this GIVEAWAY is compromised for any reason fraud, unauthorized intervention or other causes beyond the control of Lerner & Rowe) which, in the sole opinion of Lerner & Rowe, corrupts or impairs the administration, security, fairness or proper play of this GIVEAWAY, Lerner & Rowe reserves the right in its sole discretion to suspend, modify or terminate this Giveaway.
